전라도관찰사의 邪學罪人 대응 -丁亥邪獄(1827) ~ 己亥邪獄(1839)에 한정하여
지방에서 사학죄인을 체포 및 심문하는 최종 형정권자는 관찰사였다. 다만, 관찰사가 사형을 집행하기 위해서는 임금에게 계를 올리고 승인을 받아야 했다. 이 과정에서 주고받은 장계 기록은 사학죄인에 대한 관찰사의 대응을 짐작하게 한다. 전라도관찰사 이광문은 사옥 형정에 적극적인 태도를 보였다. 다만, 형정을 신중하게 처리하고자 했고, 조정에서 사학죄인에 대한 계문 접수를 미루는 상황과 맞물려 형정을 종결시키지 못했다. 이는 결국 체옥으로 이어졌다. 이들의 체옥 동안 조정에서는 신유년(1801)의 형정을 빌미로 정치적 분란을 일으키려는 조짐이 있었다. 이를 억제하기 위해 임금은 추가적인 박해나 사학죄인의 체옥 해소에 적극적인 관심을 기울이지 않았다. 전라도관찰사 조인영과 서유구는 조정과 마찬가지로 사학죄인의 체옥 문제를 긴급한 사안으로 인식하지 않았으며, 사옥 형정 진행에도 적극적인 태도를 보이지 않았다. 결국 정해사옥(1827) 때 시작된 체옥은 기해사옥(1839) 때 종결되었다. 전라도관찰사 이목연은 조정의 사학 금령에 동조하는 태도로서 옥중 사학죄인의 형정을 처리하였다. 조정에서 엄격한 사옥 형정을 재차 촉구한 뒤에는 사학죄로 이미형을 받은 정배죄인을 우선 취조하였다. 이들에 대한 형정은 조정과 지방관이 적극적으로 임하여 체옥 됨 없이 종결되었다.
Responding to criminals in the wrong way(Sahak) of the Jeolla Provincial Government - Focusing on Persecution from Jeonghae(1827) to Kihae(1839)
The final punishment authority to arrest and interrogate criminals in the wrong way(Sahak) in province was the provincial government. However, he had to report it and receive the assent of king in order to execute the death penalty. The reports between them give an idea of the response of the provincial government for the criminals. Lee Kwang-moon took an active attitude for the penal administration. However, he failed to terminate it with the situation of the court to delay the receipt for it and the situation of him to deal with it carefully. So it became Cheok(staying in prison). Jo In-young and Seo Yu-gu did not recognize the issue of imprisonment for criminals as an urgent matter, and take an active attitude for the administration. Eventually, the imprisonment from Jeonghae-persecution(1827) was terminated in Gihae-persecution(1839). Lee Mok-yeon handled the administration for criminals in the wrong way for the agreement with the court’s persecution. After the court renewed the order for the persecution, he investigated the exile criminals preferentially. The penal administration against them was terminated without imprisonment due to the active involvement of the court and him.
